General Terms and Conditions
1. Preamble
https://ravibelle.myshopify.com (hereinafter referred to as “Site”) is published by the individual company RAVIBELLE&CO, whose head office is located in Paris and registered by the Paris Commercial Court, whose SIRET number is 92788367800017.
These general conditions of sale (hereinafter “GTC”) apply to any purchase of products offered for sale on the Site (hereinafter the “Items”) selected by any consumer buyer for their own needs (hereinafter after the “Customer”) via the electronic ordering service of the Site (hereinafter the “Order”) from the company RAVIBELLE&CO (hereinafter referred to as “RAVIBELLE&CO”) They are permanently accessible on the Site.
RAVIBELLE&CO reserves the right to adapt or modify these General Terms and Conditions at any time. The version of the General Terms and Conditions applicable to any transaction being that appearing online on the Site at the time of the Order. Any Order implies acceptance of the General Terms and Conditions without reservation. Acceptance of these General Terms and Conditions is materialized by an acceptance click provided for this purpose before any validation of the Order, the terms of which are specified below.
The General Terms and Conditions constitute the entire contractual relationship between the parties and take precedence over any other document exchanged between the parties, regardless of the date of transmission to RAVIBELLE&CO. Any special conditions derogating from or additional to the General Terms and Conditions must be subject to prior written acceptance by RAVIBELLE&CO.
2. Scope
The sale of Items on the Site is exclusively reserved for retail sales and individuals.
Under no circumstances may the Site be used by professional sellers, alone or in groups, regardless of the method of marketing their products (internet marketplaces, shopping malls, intermediaries, physical stores in particular). Professional sellers must contact the RAVIBELLE&CO sales department directly.
The Customer therefore acknowledges and accepts that the Items can only be purchased in quantities corresponding to the average needs of a consumer, both with regard to the number of Items ordered in a single order and to the number of individual Orders respecting the usual quantity an average consumer spends for the same product. RAVIBELLE&CO reserves the right to refuse an order clearly validated by a professional seller Customer.
RAVIBELLE&CO reserves the right to close any customer account and consequently refuse any sale to a Customer in the following cases:
- Failure to pay one or more previous Orders,
- Non-compliance with any of the Customer's obligations defined in the General Terms and Conditions.
In the same way, the Customer may at any time inform RAVIBELLE&CO by email of his wish to close his customer account.
3. Items
The Items are offered for sale as long as they are visible on the Site, while stocks last.
In the event of unavailability of the Item after placing your order, we will inform you by email or telephone as soon as possible, offering you either to order another Item presented on the Site as a replacement, or cancel your order. RAVIBELLE&CO incurs no liability in the event of stock shortage or unavailability of Items for orders not yet accepted by RAVIBELLE&CO .
RAVIBELLE&CO reserves the right to change the Items offered on the Site at any time and without notice.
RAVIBELLE&CO takes the greatest care in the presentation and description of these products to best satisfy the Customer's information. However, it is possible that errors or non-substantial modifications may appear on the Site.
4. Orders
The Order placement procedure on the Site is subject to compliance with the different steps that the Customer must follow to validate their Order.
The Customer selects the Item(s), where applicable the size and quantity that he wishes to purchase on the Site by clicking on the “Add to cart” box.
When the Customer wishes to validate their Order, they must click on the “Order” box accessible in the “Basket” tab.
The Customer must then identify himself. When registering, they must complete the form provided for this purpose under the “Registration” tab (in particular last name, first name, email address, postal address, telephone number), this information being mandatory for processing and delivery Orders and the preparation of invoices. The Customer must read the confidentiality and processing of personal data policy and check the box provided for this purpose. If the Customer is already registered, he will fill in his username and password to identify himself.
The Customer then chooses the box corresponding to the desired delivery method. The price corresponding to each delivery method is indicated.
Then, the Customer has access to an Order summary containing in particular the price of the Items, the quantity requested, the unit cost of the Items and the delivery method and cost. At any time, the Customer may modify his Order and correct any errors.
The Customer pays by choosing the payment method and filling in the necessary fields.
After checking the summary status of the Order and clicking on the "Pay my order" button, the customer acknowledges having read and accepted all of RAVIBELLE&CO's general conditions of sale.
The Order is then registered and cannot be modified, without prejudice to the application of the article of these General Terms and Conditions relating to the right of withdrawal. Upon receipt of payment for the Order, RAVIBELLE&CO sends a confirmation email summarizing the Order (Items, price, quantity, etc.). The Order and the invoice are available in the “My account” section.
5. Price
Unless otherwise stated, the sales prices of the Items are indicated in euros (€) and are inclusive of all taxes.
These prices do not include shipping costs charged extra. These costs are indicated before the Customer places the Order and are separately mentioned in the Order summary. The total price of the Order (all taxes and shipping costs included) is indicated in the basket and at the time of the Order summary.
The different shipping methods are mentioned on the Site under the “Delivery and Returns” tab. The Customer chooses the shipping methods when placing the Order.
Concerning sales outside the European Union, prices are FOB departure from Paris. Customs clearance, payment of various duties or taxes are the responsibility of the customer.
RAVIBELLE&CO reserves the right to modify its prices at any time but the Items will be invoiced on the basis of the prices in force at the time of registration of the Order, subject to availability.
6. Payment terms
Any Order implies an obligation to pay by credit card using a sufficiently funded bank account. The Order is only final upon full payment of the price and costs associated with the Order.
The price invoiced to the Customer is the price indicated in the Order confirmation sent to the Customer by email. All orders are payable in Euros and must be paid immediately when placing your order by credit card (CB, Visa, MasterCard).
Transactions carried out on the Site are entrusted to Shopify.
This solution presents highly secure pages for entering payment data: card number, expiration date and visual cryptogram.
This platform encrypts and then transmits this payment data to the bank, in complete confidentiality and makes it inaccessible to a third party.
It is possible for the Customer to save their banking details on their account. The data in this case remains encrypted and not accessible.
7. Delivery
The Customer has the choice between several delivery methods offered during the Order process.
Delivery is made according to the delivery method chosen by the Customer as indicated in the Order confirmation. The deadlines indicated on the Site are indicative deadlines, they correspond to the average processing and delivery times. RAVIBELLE&CO cannot be held responsible for the consequences due to a delivery delay not due to its fault. Furthermore, the day after a collection is put online, the deadline may be extended to 10 (ten) days, given the volume of Orders.
Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residence address of the Customer, of a natural person of his choice or of a legal entity (delivery to his company ). Delivery cannot be made to hotels or post office boxes.
Orders are shipped on average within 24 (twenty-four) hours, but the deadline can be extended up to 10 (ten) working days. In order for these deadlines to be respected, the Customer must ensure that they have communicated accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes , names and/or intercom numbers, etc.).
RAVIBELLE&CO will deliver orders within a maximum delivery time of 14 (fourteen) working days for delivery to mainland France and 20 (twenty) working days for international delivery from the day after validation of the order. In the event of exceeding the delivery time, not justified by a case of force majeure, the Customer may request the cancellation of the sale and obtain, within a maximum period of 14 (fourteen) days following the date of termination of the contract, reimbursement of the amounts paid at the time of the sale.
8. Right of withdrawal
The Customer has a right of withdrawal for a period of 15 (fifteen) days from receipt of his Order.
The Customer must demonstrate to RAVIBELLE&CO their desire to withdraw by requesting a return on the Site, in the “My Account / My Orders” area by clicking on “Return one or more products”.
The Customer must then return the Items to RAVIBELLE&CO within 15 (fifteen) days following communication of their decision to withdraw. The Item(s) must be returned in their original packaging, in their original condition, new, unworn, unused. washed.
The return costs will be the sole responsibility of the Customer, these are a fixed amount indicated in the “Delivery and Returns” section, and will be deducted from the reimbursement.
To make a return, the Customer must follow the procedure indicated in the “Delivery and Returns” section.
All sums paid, except delivery costs, by the Customer will be reimbursed by RAVIBELLE&CO using the same means of payment as that used for payment of the Order at the latest within 14 (fourteen) days following the date of payment. date on which RAVIBELLE&CO will have received and checked the returned Item(s). In the absence of receipt of the Item(s) concerned or proof of shipment within this period, RAVIBELLE&CO reserves the right to postpone reimbursement until the day of recovery of the Item(s) ( s) concerned or the provision by the Customer of proof of shipment of the Item(s) concerned.
RAVIBELLE&CO is not required to reimburse additional costs resulting from a more expensive delivery method than the standard delivery method. Return costs are the responsibility of RAVIBELLE&CO if the Item delivered is different from the Item ordered or damaged. If the Customer fails to comply with these General Terms and Conditions, in particular the return conditions, RAVIBELLE&CO will not be able to reimburse the Items concerned.
For returns from countries outside the European Union: returns must be sent by Parcel (equivalent to Ordinary Parcel). The customer must complete the CN23 Customs Declaration, indicate a description of the goods and imperatively check the “Return of goods” box in the “consignment category”. The Customer must also attach the invoice for the Order in question to prove that it is the same merchandise.
9. Guarantees and complaints
Complaints: Upon receipt of the Items, the Customer must immediately check the condition and conformity of the Items in relation to the Order, in particular the quality and quantity of the Items and their characteristics.
If the Items do not conform to the Order or are damaged, the Customer must formulate reservations and complaints with the carrier or refuse delivery if the package is opened or damaged, and send their complaints by registered letter to RAVIBELLE&CO or by email to address ravibelleparis@gmail.com within 14 (fourteen) days following delivery. The Customer must then specify and exhaustively justify the reasons for the complaint.
No complaints will be taken into account after use of the Articles. No spontaneous returns, without agreement from RAVIBELLE&CO, will be accepted, except in the case of exercising the right of withdrawal.
Legal guarantee: The Items sold are also covered by the legal guarantee of conformity provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code and by the guarantee relating to defects in the item sold, under the conditions provided for. in articles 1641 to 1648 and 2232 of the civil code. In accordance with the provisions of Article L. 217-15 of the Consumer Code, Articles L. 217-4, L. 217-5 and L. 217-12 of the Consumer Code as well as Article 1641 and the first paragraph of Article 1648 of the civil code are reproduced hereinafter in full.
Article L. 217-4 of the Consumer Code
“The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility. »
Article L. 217-5 of the Consumer Code
“The property complies with the contract:
1) If it is suitable for the use usually expected of similar goods and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2) Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L. 217-12 of the Consumer Code
“The action resulting from the lack of conformity is prescribed two years from the delivery of the goods. »
Article 1641 of the civil code
“The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would not would have given a lower price for them, if he had known them. »
Article 1648 paragraph 1° of the civil code
“The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
Except in the cases provided for in these General Terms and Conditions, the Items sold are neither returned nor exchanged.
When acting as a legal guarantee of conformity, the consumer:
-benefits from a period of 2 (two) years from the delivery of the property to take action;
- can choose between repairing or replacing the goods, subject to the cost conditions provided for by Article L. 217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 (twenty-four) months following delivery of the goods. The legal guarantee of conformity applies independently of the commercial guarantee granted.
The consumer can decide to implement the guarantee against hidden defects in the item sold within the meaning of Article 1641 of the civil code. In this case, he can choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the civil code.
10. Liability
RAVIBELLE&CO has, for all stages of access to the Site, from the Order process to shipment of the package or subsequent services, only an obligation of means. RAVIBELLE&CO cannot be held liable for any inconveniences or damages inherent in the use of the internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any fact qualified as force majeure, in accordance with the law and jurisprudence.
